I had my state taxes done, but i never mailed them in to get my $60 refund for the past 3 years.?

I didn't care about doing my state taxes because it didn't seem like it was a big refund at the time. Now I'm worried that since i didn't mail them in that I'll get penalized for it. Or is that only true if you owe taxes back?
